Terms of Service
1. Pricing, Payment, & Queue Waitlists
a. All payments will be made through PayPal Business transactions via invoice. Taxes will apply to buyer.
b. All prices are listed in USD. (Currency conversion can be done through any google calculator)
c. All prices displayed are at projected base prices, but based on complexity and specific add-ons, including but not limited to:
Animation,
Complex background requests,
Group/party commissions,
Etc.
Prices may fluctuate.
d. For every commission in the event of a payment plan, 20% of the total price is required upfront and is non-refundable to secure a position following discussing the desired work. Commissions paid in full adhere to the same 20% nonrefundable amount.
e. Payment for commissions and payment plans can be negotiated between artist and client to accommodate any needs within reason. The terms of the payment and/or payment plans will be discussed and agreed upon between creator and client at the start of the commission. This payment plan cannot be altered in the future.
f. If no payment has taken place, a cancellation is possible at any point. If payment has been made and no work has been completed, a full refund (minus upfront retainer) can be issued at request of the client. If the commission has already been started, only a partial refund can be granted, the amount proportional to the amount of work done at the point of the refund request. This is determined based upon percent progress through each defined stage in the commissioning process.
h. *If at any point a chargeback or claim is made, the commission will immediately be canceled, all refund opportunities are forfeit, and all services for art, character designs, and products will no longer be offered to the client in the future.2. Commissioning Process
a. My commission queue fluctuates between each wave, therefore an inconsistent queue is to be expected. For each wave, I will take no more than 5 commission slots at a time.
b. Digital painting commissions can take up to or more than 2 months1 from the start of the project not including queue time. My Trello queue can be found in my Carrd.co links and can give a general idea of how long the wait can take. My private messages are always open to commissioners in case you have questions or would like to discuss further details about the order.
c. The digital painting process is broken up into 1/3rds, defining each stage of the process and refund percentages:
Stage 1: Sketches and Thumbnails
During the sketch phase, we are working on composition of a piece and creative direction can either by client guided with reference images or specific described ideas OR creative freedom at the artist's discretion. I can create multiple concepts during this stage to meet the expectations and desires of the client.
Stage 2: Clean sketch, Flat colors, and Compositional lighting
During the cleaning phase, we have solidified a composition and will begin to work on large-scale details such as environmental lighting, background details, and creating a clean sketch to begin the final painting phase. While I will not rework the WIP from here, I am able to make changes to details in the artwork.
Stage 3: Painting and Detail work
During the painting phase, all large details have been decided upon and I will begin to render textures, lighting, and shading on the background and focal character(s). This is the longest part of the process and takes time to make a product you can be happy with; please be patient!
d. WIP images are provided by default during the working period of your order. These will typically occur during the sketching phase/thumbnails, and periodically throughout the painting/creation process. If there are any details that need to be discussed or any confusion about a design, I will be sure to message before proceeding to provide the most accuracy to the reference material as possible!
e. Changes may be requested at each WIP stage! Small changes are available for free later into the process, but large-scale changes such as background, pose, etc. should be discussed at the sketching and thumbnail phase. If there are any large changes you wish to add into the painting process, it doesn’t hurt to ask. I'd be happy to negotiate! My main priority is making sure you’re happy with the work you receive.
f. I reserve the right to refuse changes if it will clash with my artistic style or negatively impact the quality of the final piece, but changes made due to an error on my part (missing wings, tail, extra eyes, etc.) will be done for free.
1When giving a general estimate for working on a commission, that is not a strict deadline nor is it a promise I will be able to work at that time should other extenuating circumstances arise. I will not work on strict deadlines, nor will I work when requested due to handling other business at the same time as my freelance commissions.3. Commissioning Process +
a. Custom character designs apply to the maximum queue, however only one will be taken at a time to ensure a consistent quality and turn-around time.
b. WIP images will be provided by default during the working period of your order. These will include (1) general rough concepts and silhouettes based upon either original commissioner direction or request following artist concepts, (2) clean doodles to solidify the design, and (3) an official final artwork. This process follows the same 1/3rds principle.
c. At commissioner request, alterations can be made to a design at any stage. Priority is placed on ensuring the commissioner is satisfied with the produced character.
d. During custom designs or redesigns for closed species or alike communities with guidelines and regulations following character creation and overhaul, I will continue to work with you and make alterations until an official design has been approved. Following the creation of the first official final artwork, clients are no longer eligible for refund.4. Commissioner & Creator Rights
a. By default, commissions are for non-commercial use only! Commissioners can use the commissioned art as profile pictures, background images, uploaded to online galleries and printed for personal use. Commissioners may not profit off of the commissioned artwork(s) in any form.
b. All rights to WIP concepts, sketches, and otherwise incomplete drafts remain with the artist and can be recycled in future projects without impacting the originality of the commissioner’s finished product.
c. All rights of the finished artwork remain with the artist, including the right to sell the piece as prints, or on online platforms such as Patreon.
d. Character rights will remain with the owner of the character, ex. If the character belongs to the commissioner, character rights belong to the commissioner. All artworks of popular characters from any form of public media are considered fan art and the rights to the copyrighted characters are retained by the creator of the character.
e. Usage rights of the commissioned artwork may be negotiated if the commissioner wishes to use the digital art commercially. The new terms will vary depending upon the agreement between creator and commissioner.
f. I reserve the right as an artist to cancel commissions at any point without explanation. Should I cancel your commission early, I will provide an appropriate refund depending upon how far into the artwork I’ve gotten.5. Artist Preferences
a. I am comfortable working with furry (feral and anthro), monster or human/humanoid characters, detailed patterning, clothing and mech, copyrighted characters, gore and NSFW. If you have any commission type requests that have not been listed, feel free to message me using email or Instagram direct messages to discuss details further!
b. I will not accept any commission request with NSFW involving feral animals, children, dead bodies, excretory bodily fluids, or extreme torture. Gore in NSFW can be discussed, but can be rejected at any point if it exceeds my personal boundaries.
c. All NSFW artworks will require ID proof of being 18 or older.
